Private NUA lanes - Case study - NUA lane abutting 85 Templeton Street, Wangaratta The NUA (Not Under Act) / Old Law lane abutting 85 Templeton Street, Wangaratta was created by Application around 1893 by John C Marshall, who transferred out the surrounding parcels leaving the lane in his name. Survey records have not charted the original Application number. As these lanes were generally not transferred out, it is still in the name of the original developer Mr Marshal, who died on the 26 November 1904 and is buried in the Wangaratta cemetery. The lane is defined as per the Old Law diagram abutting 85 Templeton Street. The lane is private and maintenance is carried out informally by adjoining owners. The owners fill in the pot holes. The current owner (Mr Marshall) or his descendants did not set up a trust / fund for maintenance. The lane is not on Council’s Road Management Act register as it is private. Council has no interest in maintaining this private lane. How then is maintenance and public liability dealt with over this Lane? What are the options to bring this lane back into our modern Cadastre? If the subdivision was done today, it would most likely become common property and maintenance and liability dealt with by an Owners Corporation. Discussions could begin with bringing the lane under the TLA using section 23? The lane needs an identifier on VicMap (SPI number & TP). This could happen, but it would still be in Mr Marshall's name. Once converted to the Torren system, one option could be that Council use Section 59 of the TLA to bring it into their name and charge a levee to adjoining owners for maintenance and liability? Now on Council's Road Management Act Register. Else should the lane be converted to common property? No legislation at present to do so. For this to happen a new Plan of Subdivision is required, with agreement from all parties to join the Owners Corporation structure. This would be expensive and without agreement from all parties, not practical. It seems we are back to the Road Management Act? As we are into the twentieth year of the Road Management Act 2004, maybe a rewrite to deal with private lanes including NUA private lanes is required? This could form part of the 10 year Strategy for Victoria's Cadastral System currently up for review. Either way, an investment in bringing all land under the Act is required and a review of the Road Management Act to ensure all roads are covered for maintenance and liability. #geospatial#cadastral#digitalcadastre#interoperability#surveying

Errors in VicMap and NUA (Not Under Act) roads effecting land development - Case study in Moolap A current development South of 480 Portarlington Road, Moolap, abutts Patrick Street, Ballinamona Street and Buttevant Street(All Unmade NUA Roads). See Moolap Chart 13. They are not on Council’s Road Management Act Register. Stehana Street, Charlesville Street and Limerick Street have been closed many years ago and form part of the development’s title. VicMap line work for Patrick Street appears to be in error by 2 metres (Approx 18m), but Sheet 6 of AP32491 shows Patrick Street partly obscured, but with a width of 102 links = 20.52 m. An NUA search through Feigl and Newell (Only Old Law/ NUA searching company in Victoria now) would most likely find that the road was originally intended to be 100 links or 20.12m? Search cost is around $600 plus and takes around 3 months. The land (480 Portarlington Road) to the North of Patrick Street is shown in Title (TP959367), which may also have errors in it. Further complicating the issue, is the fact the owner of 480 Portarlington Road has illegally built a shed into Patrick Street and their fencing sits well within Patrick Street. See aerial. Council could consider ordering a NUA search ( info@feiglnewell.com.au ) and bringing the land under the Transfer of Land Act using Section 23. Council could then use Section 59 of the TLA to bring Patrick Street, Ballinamona Street and Buttevant Street into Council’s name. The owner could then look to buy the land from Council , lease the land from Council or move the shed. At present the owner of 480 Portarlington Road could seek to do an adverse possession of the land(Occupied for over 30 years with disinterested witness), however Land Use Victoria still requires a letter from Council stating it is not a road on their Road Management Act Register. Further issues for development The engineering design has had to be amended because ownership concerns with Patrick Street(NUA Road) and service construction is required through to Portarlington Road along the unmade Ballinamona Street, which is also being adversely occupied by the owner to the West. Suggestions for resolving The Applications Branch are provided funding to meet their legal obligations under the Transfer of Land (Single Register) Act to resolve the Tens of Thousands of NUA remnant pieces and roads and bring those transferrable parcels under the Act. Ownership clarity on VicMap should be a given.

Bringing NUA Roads under the Transfer of Land Act (TLA) STQC are enjoying working on this very interesting project with Melbourne City Council to bring all NUA Roads under the TLA. The project involves searching NUA (Not under Act / Old Law) Roads within the City boundaries through Feigl and Newell, then Melbourne City Council makes a request to the Applications Branch at Land Use Victoria under Section 23 of the TLA to bring that NUA Road under the TLA. Melbourne City Council then applies to bring the road ownership into Council’s name using Section 59 of the TLA. This process has many benefits to the Victorian Cadastre. It meets the intention of the Transfer of Land (Single Register) Act 1998, which once finalised will allow all parcels to have a SPI and therefore be searchable. This then allows for land status and the management entity to be efficiently searched as the parcel will have it's own Title Plan. Further benefits will be around the updating of Council’s Road Management Act Register. Not long to go now and Melbourne City Council won’t have any NUA parcels! Below is a General Law search of Avis Lane in North Melbourne. The land now is searchable as TP971759.
